Abstract

Comparison of the Powers of the Czech and Slovak Presidents in Relation to the Government Abstract The Czech Republic and Slovakia share a constitutional history of more than 70 years of a common president. However, the subsequent post-revolutionary developments in both countries have shown that the perception of the head of state in the Czech Republic and Slovakia differs in many ways. It is therefore worth considering whether this different perception of the presidents in the eyes of the public has also been reflected in the powers granted to the presidents by the Czech and Slovak constitutions after the division of the common state. Considering the scope of the work, the chosen comparative powers are those that the President of the Republic has vis-à-vis the second constitutionally enshrined branch of the executive branch - the government. Indeed, it is the setting of the relationship between the government and the president that determines to a large extent who actually governs the country. Srovnání pravomocí českého a slovenského prezidenta ve vztahu k vládě Abstrakt Česko a Slovensko spojuje více než 70 let ústavní historie, kdy stál v čele státu společný prezident. Následný porevoluční vývoj v obou zemích však ukázal, že vnímání hlavy státu je v Česku i na Slovensku v mnohém odlišné. Nabízí se proto zamyšlení, zda se toto odlišné vnímání prezidentů v očích veřejnosti projevilo také v pravomocích, které po rozdělení společného státu prezidentům přiznal český a slovenský ústavodárce. Vzhledem k rozsahu práce jsou zvolenými srovnávanými pravomocemi ty, které má prezident republiky vůči druhé ústavně zakotvené složce výkonné moci - vládě. Právě nastavení vztahů mezi vládou a prezidentem totiž do značné míry určuje, kdo v zemi skutečně vládne. Navíc bývá předmětem častých diskuzí a politických sporů. Diplomová práce ve třech částech srovnává vybrané pravomoci českého a slovenského prezidenta republiky ve vztahu k vládě. První část se zabývá pravomocí prezidenta jmenovat a odvolat předsedu a členy vlády. Druhá část práce srovnává české a slovenské pojetí pravomoci prezidenta vyžadovat si od vlády a jejích členů informace. Třetí část práce se zaměřuje na prezidentovy pravomoci v případě, kdy vláda nezíská nebo ztratí důvěru parlamentu, případně podá demisi. Cílem srovnání je zhodnotit, zda by bylo...
