Abstract

1 Abstrakt Autorskoprávní ochrana architektonických děl Diplomová práce pojednává o problematice autorskoprávní ochrany architektonických děl se zaměřením na architektonické dílo, jeho jednotlivé pojmové znaky a zkoumání limitů autorskoprávní ochrany architektonických děl. Hlavním cílem této práce je snaha o podrobnou analýzu a srovnání příslušné národní i evropské právní úpravy a současného vývoje na poli judikatury, přičemž prostřednictvím analyticko-komparativní metody podat přehledný výklad dané problematiky a překlenout tak nedostatek ustálené soudní praxe a odborné právní nauky v otázce některých specifických zákonných pojmů autorského práva. Práce je rozdělena do tří samostatných kapitol, a to následovně: V pomyslné obecné části této práce, kterou tvoří první dvě kapitoly, jsou vymezeny teoretické základy autorského práva v architektuře. V první kapitole je zmíněna obecná charakteristika a principy autorského práva a definováno autorské dílo jako předmět autorského práva včetně jeho jednotlivých pojmových znaků. Druhá kapitola pojednává o autorském právu v architektuře, kdy obsahuje stručné vymezení pojmu architektury a podrobnou analýzu architektonického díla a jeho jednotlivých pojmových znaků se zaměřením na určitá specifika. 1 Abstract Copyright Protection of Architectural Works The thesis deals with the issue of copyright protection of architectural works, focusing on the architectural work and the individual conceptual features, as well as the analysis of the limits of copyright protection of architectural works. The main aim of this thesis is to provide a comprehensive analysis and comparison of the relevant national and European legislation and the recent developments in case law, while presenting a clear interpretation of the given issue using the analytical-comparative method. Thus, it aims to bridge the lack of consistent case law and expert legal doctrine regarding some of the specific legal terms of copyright. The thesis is divided into three separate chapters, as follows: The general part of this thesis, which consists of the first two chapters, defines the theoretical foundations of the copyright in architecture. The first chapter presents the general characteristics and principles of the copyright and defines the copyright work as an object of copyright, including the individual conceptual features.
