Abstract

Evolution of the assessment of discrimination in the case law of the Constitutional Court Abstract The thesis focuses on the case law practice of the Constitutional Court in discrimination cases, analysing its development and the changes in its premises over time. The thesis critically compares the grounds set by the Constitutional Court with the actual practice of the Constitutional Court and evaluates the frequency of their application. The main theme of the thesis is the concept of accessory equality, which is one of the key grounds for the Constitutional Court's review in this area. In its introduction, the thesis deals with the theoretical anchoring of the issue under study, defining the basic concepts and institutes necessary for understanding the problematic and the issues outlined in the thesis. It clarifies the concept of equality and its accessority, as well as the concept of discrimination. The research part of the thesis is structured according to case law periods reflecting the development of the Constitutional Court's approach to the review of violations of the principles of equality. Vývoj posuzování diskriminace v judikatuře Ústavního soudu Abstrakt Diplomová práce se zaměřuje na rozhodovací praxi Ústavního soudu v diskriminačních věcech, přičemž analyzuje její vývoj a proměny východisek, které v průběhu času zaznamenala. Východiska stanovená Ústavním soudem práce kriticky srovnává se skutečným postupem Ústavního soudu a posuzuje četnost jejich aplikace. Ústředním tématem práce je koncept akcesority rovnosti, jenž představuje jedno z klíčových východisek pro přezkum Ústavním soudem v této oblasti. Práce se ve svém úvodu věnuje teoretickému ukotvení zkoumané problematiky, přičemž vymezuje základní pojmy a instituty nezbytné pro porozumění problematice a otázkám, které jsou v práci dále nastíněny. Zejména objasňuje koncept rovnosti a její akcesoritu, jakož i koncept diskriminace. Výzkumná část práce je strukturována podle judikatorních období, jež odrážejí vývoj přístupu Ústavního soudu k přezkumu porušení principů rovnosti.
