Abstract

Selected Issues of Free Movement of Patients in the European Union The Thesis focuses on aspects of cross-border patient mobility within the European Union. Specifically, the first objective of the thesis was to analyse and compare transposition of Directive 2011/24/EU of the European Parliament and of the Council on the application of patients' rights into legal systems of the Czech Republic and the Republic of Ireland. The analysis showed that the transposition in both states was generally liberal and supportive of patient mobility. The comparison revealed that despite some differences in organisation of health and social security systems, both countries are very similar in their approach towards the transposition of the Directive. The second objective of the thesis was to assess the impact of the Directive on overall patient mobility within the EU. For this analysis, the author used data collected by the European Commission between the years of 2015 and 2022. The analysis showed that the Directive had contributed to increase the level of patient mobility between Member States, however, the level of impact varies significantly between Member States. Vybrané otázky volného pohybu pacientů v Evropské unii Diplomová práce se věnuje aspektům přeshraniční mobility pacientů v rámci Evropské unie. Konkrétně prvním cílem práce bylo analyzovat a porovnat transpozici Směrnice Evropského parlamentu a Rady 2011/24/EU o právech pacientů do právních řádů České republiky a Irské republiky. Analýza ukázala, že transpozice v obou státech byla veskrze liberální a podporující mobilitu pacientů. Srovnání odhalilo, že i přes určité rozdíly v organizaci systémů zdravotnictví a sociálního zabezpečení jsou si obě země svým přístupem k transpozici Směrnice velice blízké. Druhým cílem práce bylo vyhodnotit dopad Směrnice na celkovou mobilitu pacientů v rámci EU. Pro tuto analýzu autorka použila data, sbíraná Evropskou komisí mezi lety 2015 až 2022. Analýza ukázala, že Směrnice přispěla k nárůstu míry mobility pacientů mezi členskými státy. Míra dopadu se ovšem mezi jednotlivými členskými státy výrazně liší. Za těmito rozdíly stojí různé faktory a analýza tak prokázala, že pacienti z různých členských států mají odlišné potřeby a k přeshraniční mobilitě je vedou jiné důvody.
