Abstract

Protection of infant in the EU law and its proportionality with regards to EU Charter of Fundamental Rights Abstract This thesis examines the conformity of EU law infant protection instruments with EU Charter, both of those purposefully protecting this vulnerable group and of those having effect on more general population but influencing infants' life significantly. More intrusive clauses, that are not only of pure safety and compositional standard nature are subjected to proportionality test as developed in CJEU case-law, with regards to specificities of examined topic, notably the regulation of baby/infant/milk formulas (internationally regulated under the term of breast-milk substitutes). Before conducting the balancing exercise, relevant legislation is analysed using interpretive methods of textual, teleological (by discussing aims of the concerned regulatory framework), historical (by focusing on context of legislation adoption) and systematic (comparing both preceding legislation and relevant related in-force legislation) interpretation. The result of analysis is also applied in specific conditions of infants involving the role of caregiver in their protection, revealing potential gaps in the legislation. Ochrana kojence v právu Evropské Unie a její proporcionalita s ohledem na Listinu základních práv Evropské Unie Abstrakt Tato práce zkoumá soulad nástrojů ochrany kojenců v právu EU s Listinou základních práv EU, a to jak těch, které cíleně chrání tuto zranitelnou skupinu, tak těch, které působí na širší populaci, ale významně ovlivňují život kojenců. Ustanovení, která s větší intenzitou zasahují do práv jiných a která nestanoví pouze čistě bezpečnostní standardy a náležitosti složení, jsou podrobeny testu proporcionality, jak byl vyvinut v judikatuře Soudního dvora EU, s ohledem na specifika zkoumaného tématu, zejména na regulaci kojenecké/mléčné výživy (mezinárodně regulované pod termínem náhrad mateřského mléka). Před provedením bilancování je příslušná legislativa analyzována pomocí interpretačních metod jazykového, teleologického (prodiskutováním cílů příslušného regulačního rámce), historického (zaměřením se na kontext přijímání legislativy) a systematického (srovnáním jak předchozí legislativy, tak relevantních souvisejících účinných právních aktů) výkladu. Výsledek analýzy je aplikován i na specifickou situaci kojenců zahrnující roli pečující osoby při jejich ochraně a odhaluje potenciální mezery v legislativě.
