Poker

Abstract

The purpose of this diploma is to answer the research question that poker is closer to the legal nature of sport than gambling and to assess whether the current tax regulation of gambling, especially live gambling, is sufficient in the context of the research question. The first chapters describe the current regulation of gambling and sport. At the same time, the conceptual features of gambling, sport are discussed in detail and at the end of Chapter 2 the mathematical and probabilistic aspects of live gambling are analysed. These findings are then compared with the detailed analysis of poker. The conclusion of the thesis contains ways of legislative changes and benefits that would flow from the changed view of poker.

Účelem diplomové práce je zodpovězení výzkumné otázky, že poker je bližší právní povaze sportu, nežli hazardní hře a posouzení, zda je současná daňová úprava hazardních her, především her živých, v kontextu výzkumné otázky dostatečná. V prvních kapitolách je popsána současná právní úprava hazardních her a sportu. Zároveň jsou podrobně rozebrány pojmové znaky hazardní hry, sportu a na konci 2. kapitoly je analyzována matematická a pravděpodobnostní stránka hazardních her živé hry. Tyto poznatky jsou následně komparovány s podrobnou analýzou pokeru. Závěr práce obsahuje způsoby legislativních změn a výhody, které by ze změněného náhledu na poker plynuly.
