Abstract

Gender reassignment in the context of human rights Abstract The thesis deals with the issue of gender reassignment in the context of human rights. From a marginal topic affecting only a small part of the population, it has become a phenomenon discussed by the entire society in the present time. The thesis deals with the issue of gender reassignment in the context of human rights. In the introduction, it provides an insight into the human rights related to gender reassignment, such as bodily integrity, the right to self-determination or the right to human dignity and the related prohibition of torture, then an introduction to the issue of persons affected by gender reassignment, an explanation of basic concepts, such as the concept of gender itself in its individual levels, the difference between trans and intersex persons, an excursion into the issue of normalization procedures and an excursion into the issue of surgical gender reassignment itself and the consequences it brings with it. It also analyses the legal regulation of gender reassignment in individual legal regulations that is still valid. Změna pohlaví v kontextu lidských práv Abstrakt Diplomová práce se věnuje problematice změny pohlaví v kontextu lidských práv. Z okrajového tématu, týkajícího se jen malé části populace se stal celospolečensky diskutovaný fenomén současné doby. Práce se zabývá problematikou změny pohlaví v kontextu lidských práv. V úvodu poskytuje náhled na lidská práva související se změnou pohlaví jako je tělesná integrita, právo na sebeurčení nebo právo na lidskou důstojnost a s ním související zákaz mučení, dále úvod do problematiky osob, kterých se změna pohlaví týká, vysvětlením základních pojmů, jako je samotný pojem pohlaví v jeho jednotlivých rovinách, rozdíl mezi trans a intersex osobami, exkurz do problematiky normalizačních zákroků a exkurz do problematiky samotné chirurgické změny pohlaví a důsledků, které s sebou přináší. Dále analyzuje zatím stále ještě platnou právní úpravu změny pohlaví v jednotlivých právních předpisech. V následující části se zabývá výkladem Evropských lidskoprávních standardů a to zejména prostřednictvím rozboru jednotlivých rozhodnutí Evropského soudu pro lidská práva ve věcech změny pohlaví a rozhodnutí Evropského výboru pro sociální práva ve věci Transgender Europe a ILGA - Europe proti české republice.
