Abstract

Joint Investigation Teams from the point of view of the Czech Republic Abstract The thesis focuses on the development and functioning of joint investigation teams (JITs) within the EU and international cooperation in criminal matters. The main objective is to describe how this institute has developed from the initial discussions that took place more than thirty years ago to its current legal anchoring and functioning within the EU, including the Czech legal environment, supplemented by practical experience from case law and statistical and specific data on the activities of JITs and the involvement of the Czech Republic. The thesis thus addresses both the theoretical framework of cross-border cooperation, including international conventions and European legal norms, and practical examples and statistical data on the involvement of the Czech Republic in JITs. In the context of international law, selected examples of Council of Europe and UN conventions are presented; from the perspective of EU law, it is a main assessment of the development of primary law and a description of the current valid legal regulation that affects JITs. Společné vyšetřovací týmy z pohledu České republiky Abstrakt Práce se zaměřuje na vývoj a fungování společných vyšetřovacích týmů (SVT) v rámci EU a mezinárodní spolupráce v trestních věcech. Hlavním cílem je popsat, jak se tento institut vyvinul od počátečních diskusí, které proběhly před více než třiceti lety, až po jeho aktuální právní zakotvení a fungování v rámci EU, včetně českého právního prostředí, s doplněním o praktické zkušenosti z judikatury a statistických i konkrétních údajů o činnosti SVT a zapojení České republiky. Práce se tak věnuje jak teoretickému rámci přeshraniční spolupráce, zahrnující mezinárodní úmluvy a evropské právní normy, tak i praktickým příkladům a statistickým údajům o zapojení ČR do SVT. V kontextu mezinárodního práva jsou uvedeny vybrané příklady úmluv Rady Evropy a OSN, z pohledu unijního práva se jedná o hlavní zhodnocení vývoje primárního práva a popis stávající platné právní úpravy, která se SVT dotýká. Uvedeny jsou rovněž právní instituty mezinárodní spolupráce, které mohou přicházet v úvahu na místo užití SVT, a to i z pohledu českého právního rámce. Práce dále představuje konkrétní případy spolupráce, kdy se do SVT zapojila ČR.
