Abstract

European standard against hate speech and its reflexion into criminal law Abstract This rigorous thesis focuses on the European standard of combating hate speech and its reflection in the criminal law of the Czech Republic, where the main objective is primarily to analyse whether the European legal norms, including the legislation of the Council of Europe, the European Union and the case law of the European Court of Human Rights and the Court of Justice of the European Union, are sufficiently reflected in national legislation. The thesis examines the European legal framework to combat hate speech and its reflection in the Czech Criminal Code, which primarily assesses whether the Czech legislation complies with European standards. The thesis concludes with a summary of the findings and an evaluation of the effectiveness of combating and criminalizing hate speech, taking into account, in particular, the boundary between the right to freedom of expression and the protection against hate speech and resentment, which are unacceptable in a democratic society. The paper also identifies possible problems associated with the implementation of these standards in national legal systems. Key words: hate speech, freedom of expression, hate crimes

Evropský standard boje proti nenávistným projevům a jeho promítnutí do trestního práva Abstrakt Tato rigorózní práce se zaměřuje na evropský standard boje proti nenávistným projevům a jeho promítnutí do trestního práva České republiky, kdy hlavním cíle je primárně analyzovat, zda evropské právní normy, zejména legislativa Rady Evropy, Evropské unie a judikatura Evropského soudu pro lidská práva a Soudního dvoru Evropské unie, jsou dostatečně reflektovány ve vnitrostátní právní úpravě. Práce tedy zkoumá evropský právní rámec v boji proti nenávistným projevům a jeho promítnutí do českého trestního zákoníku, kdy se zabývá posouzením, zda česká právní úprava odpovídá evropským standardům. V závěru této práce je shrnuto zjištění a hodnocena efektivita potírání a kriminalizace nenávistných projevů, přičemž v potaz je především brána hranice mezi právem na svobodu projevu a ochranu proti projevům šířícím nenávist a zášť, jež jsou nepřípustné v demokratické společnosti. Práce taktéž identifikuje možné problémy spojené s implementací těchto standardů do národních právních systémů. Klíčová slova: nenávistné projevy, svoboda projevu, nenávistné trestné činy
