Zánik členství v bytovém družstvu

Abstract

For several years, the housing sector has been marked by severe unaffordability due to a shortage of flats, high purchase prices and rising rents. One possible solution to this situation is housing cooperatives, which allow their members to rent a cooperative flat for often lower rental amounts than in the case of a "classic" lease. However, this benefit of cooperative housing is also linked, inter alia, to the condition that the member of the housing cooperative is obliged to comply with the rules and conditions set by the corporation. Otherwise, the housing corporation is entitled to decide to expel the member and the validity of that decision does not require the approval of the court. This concept of expulsion as an internal decision-making process of the cooperative is based on the historical principles of cooperative societies, and of all forms of commercial corporations, only cooperatives are entitled to interfere with their membership base in this way. V současné době oblast bydlení už několikátým rokem charakterizuje především jeho celková nedostupnost vyplývající z nedostatečného počtu bytů, vysokých kupních cen a vysokých nájmů. Jedním z možných řešení této situace jsou bytová družstva, která umožňují jejich členům získat do nájmu družstevní byt za často nižší nájemní částky, než v případě "klasického" nájmu. Tento benefit družstevního bydlení je však zároveň spojen mj. s podmínkou, podle níž je člen bytového družstva povinen zachovávat pravidla a podmínky stanovené touto korporací. V opačném případě je totiž bytové družstvo oprávněno rozhodnout o vyloučení člena a k platnosti tohoto rozhodnutí není vyžadováno přivolení soudu. Tato koncepce vyloučení jako vnitřního rozhodovacího procesu družstva vychází z historických principů družstevnictví a ze všech forem obchodních korporací je pouze družstvo oprávněno takto samostatně zasahovat do své členské základny. Tato diplomová práce se tedy, i přes svůj název, zaměřuje pouze na jeden ze způsobů zániku členství v bytovém družstvu, a to na vyloučení člena. Po úvodních kapitolách, v nichž autor stručně nastiňuje historii bytového družstevnictví, vymezuje pojem a povahu bytového družstva a popisuje členství v této korporaci, je jádro diplomové práce rozděleno do dvou rozsahově obdobných kapitol.
