Vzájemná důvěra v právu Evropské unie

Abstract

The aim of the doctoral thesis is to contribute to clarifying the concept of mutual trust in EU Law in two respects. First, the thesis examines the purposes, meanings and contexts in which mutual trust is invoked within the EU law by the EU legislation, the executive and the Court of Justice. In this respect, it outlines the EU concept of mutual trust, compares it with the understanding of trust in the social sciences and examines the extent to which it is legally relevant for the use of mutual recognition. Secondly, the thesis analyses the legal characteristics and operationalisation of mutual trust in application practice of certain mutual recognition mechanisms. In this respect, it analyses the legal prin-ciple of mutual trust, and particularly its essence, legal basis, legal effects, substantive and personal scope of application and corresponding limits.

Cílem disertační práce je přispět k objasnění unijního pojetí vzájemné důvěry v právu EU ve dvou ohledech. Za prvé, práce zkoumá účely, významy a kontexty, v nichž v rámci unijního práva vzájemnou důvěru využívá unijní legislativa, exekutiva a Soudní dvůr. V tomto směru práce vymezuje unijní pojetí vzájemné důvěry, porovnává jej s chápáním důvěry ve společenských vědách a posuzuje, v jaké míře je toto pojetí relevantní v právně aplikační rovině uplatňování vzájemného uznávání. Za druhé, práce analyzuje právní charakteristiky a operacionalizaci vzájemné důvěry v aplikační praxi vybraných mechanismů vzájemného uznávání. V tomto směru je předmětem analýzy právní zásada vzájemné důvěry, a především její podstata, právní základ, právní účinky, věcný a personální rozsah použití a odpovídající limity.
