Abstract

Trestněprávní postih výroby drog v mezinárodním srovnání a způsoby jejího odhalování Abstrakt Tato práce se zabývá výrobou drog a dělí se na dvě stěžejní části. V první části pojednává o trestněprávním postihu výroby drog a její právní úpravě v České republice, kterou následně srovnává se zahraniční právní úpravou, a to v sousedních zemích s totožnou právní kulturou - Spolkovou republikou Německo a Rakouskou republikou. Druhá část této práce je pak věnována odhalování trestné činnost spočívající ve výrobě drog jako odpovědi na drogovou kriminalitu samotnou a nutné podmínce pro možnost uplatnit vůči jejím pachatelům jakýkoliv trestněprávní postih. V první kapitole bude velmi stručně představen pojem drog jako stěžejní pro celou práci. Následují dvě kapitoly, které představí mezinárodněprávní rámec nakládání s drogami a trestání nedovoleného nakládání s látkami označovanými jako drogy, tedy i výroby drog, a to v rámci úmluv přijatých mezinárodním společenstvím na půdě Organizace spojených národů v kapitole druhé, a v rámci předpisů Evropské unie v kapitole třetí. Criminal sanctions of drugs manufacturing in international comparison and means of its exposure Abstract This thesis deals with the topic of drugs manufacturing and is divided into two key sections. The first section discusses the criminal sanctions of illicit manufacturing of drugs and their legal regulation in the Czech Republic, which is then subject to comparison with foreign legal regulations in particular with those of the neighbouring states which share the same legal culture as the Czech Republic - the Federal Republic of Germany and the Republic of Austria. The second part of this thesis is dedicated to the process of exposure of criminal conduct consisting of illicit manufacturing of drugs as the answer to drugs-related criminality itself and as the necessary precondition to having the possibility to apply any criminal sanctions against the perpetrators whatsoever. In the first chapter the term drug is very briefly introduced as key for the whole thesis. Two chapters follow which introduce the international framework for any drug traffic and setting criminal sanctions for illicit drug traffic with chapter two focusing on the treaties adopted by the international commonwealth on the grounds of the United Nations and with chapter three focusing on the legal regulation of the European union.
