Případ Waterloo

Abstract

Tato bakalářská práce si klade za úkol analyzovat trestní řízení se členy divadla Waterloo, které probíhalo v Ostravě r. 1971-1972. Členové divadla byli stíháni a souzeni za inscenování několika společensky kritických, až satirických děl. Nejproblematičtějším kusem byla parodie na prózu Vladimíra Katajeva Syn Pluku. Proces se opíral jednak o znalecké posudky inscenovaných textů, jednak o výslechy obviněných a svědků. Pro čtyři obviněné (konkrétně Petra Podhrázkého, Petra Ullmanna, Ivana Binara a Edvarda Schiffauera) skončil soud nepodmíněným odnětím svobody. Tento trest je ovlivnil nejen v době pobytu ve vězení, ale poznamenal i zbytek jejich života. Výzkum se opírá o rozbor důkazů, které měla k dispozici státní policie a soud při trestním stíhání. Práce obsahuje analýzu soudních posudků, které byly hlavním důkazním materiálnem. Dále rozebírá výslechy obviněných a svědků a průběh celého soudního jednání na základě protokolu z líčení. Navíc je práce doplněna o autentické rozhovory s pamětníky. Výzkum dokládá jednostrannost celého procesu, kdy obvinění neměli možnost výsledek zvrátit jiným způsobem, nežli spoluprací s politickým systémem, tedy souhlasem s praktikami KSČ, či podepsáním faktické spolupráce s StB. Z práce vyplývá, že šlo o exemplární trest, který měl zastrašit společnost.

This bachelor dissertation heads to an analysis of a criminal prosecution with members of The Theatre Waterloo, which took part in Ostrava in the years 1971 and 1972. The members of the theatre were prosecuted and judged for putting on stage of several social critical and even satirical plays. The most problematic piece of work was a parody of Russian novel of Valentin Katajev's Son polka. The prosecution was based on an expert opinion of produced texts and interrogation of the charged and witnesses. However the proces had been finished by a custodial sentence for four of them (namely Petr Podhrazky, Petr Ullmann, Ivan Binar and Edvard Schiffauer). This punishment influenced either their lives during the stay in custody or it affected their whole lives. The dissertation study is found on the analysis of evidence which the State Police and court had at disposal. The dissertation consists of an analysis of the expert opinion which was the main source of evidence. Furthermore it examines the intterogations of prosecuted members of the theatre and witnesses, it examines the progress of the whole trial on the base of judicial proceedings.
