Dual process theory|moral judgement|deontology|consequentialism|punishmenFilosof a psycholog Joshua Greene přišel s tzv. dual process theory, teorií morálního rozhodování, která v sobě snoubí racionalismus a intuicionismus. Říká, že během morálního rozhodování hrají svou roli jak nevědomé, emoční procesy, tak procesy vědomé a více racionální. Zároveň je spojuje s typem úsudku, ke kterému člověk dospěje. Rozhoduje-li se na základě intuice, častěji dojde k deontologickému úsudku a naopak převládne-li rozumové zpracování informací, dospěje spíše ke konsekvencialistickému úsudku. Svou teorii podpírá důkazy ze studií využívajících funkční magnetickou rezonanci i behaviorální data, a to především reakční čas a manipulaci s kognitivní zátěží. Tato práce kriticky teorii zkoumá a předkládá jak důkazy svědčící pro její platnost, tak i ty, které ji zpochybňují. Dále se věnuje jedné z možných aplikací poznatků o mechanismu morálního rozhodování u člověka, a to rozhodování o odpovědnosti a výši trestu pro obžalovaného v rámci trestního řízení. V empirické části nakonec předkládá návrh výzkumu, který sleduje roli emocí, konkrétně hněvu, během usuzování na odpovědnost člověka, který se dopustil přestupku či trestného činu, a následného vyměřování spravedlivého trestu. The philosopher and psychologist Joshua Greene came up with a theory of moral judgement that integrates both rationalism and intuitionism - the dual process theory. It says that during moral judgement the unconscious, emotional processes as well as the conscious, rational processes play an important role. At the same time it binds together the process and the respective moral output. If the judgement is made based on intuition, it will be of a deontological type and on the other hand the controlled processing leads to a consequentialist judgement. He supports his theory with evidences from neuroimaging studies as well as behavioral evidences - mainly the reaction times and manipulation with cognitive load. This work examines the theory and presents evidences speaking in favor as well as against it. Furthermore, it is focused on one of the possible applications of understanding human moral judgement - assessing responsibility and determining an appropriate punishment for a perpetrator in a legal process. Specifically, in the empirical part, it proposes an experiment examining the role of emotions, specifically anger, in assessing the responsibility of a transgressor and in calculating the deserved punishment.
