Mezinárodní smlouvy o dodávce investičních celků

Abstract

Resumé Cílem práce je představit pojem investičního celku a investiční výstavby a problematiku spojenou s jejich vymezením. Dále se zaměřuje na shrnutí typických znaků a některých specifik vybraných zásadních mezinárodních dokumentů, které se zabývají problematikou mezinárodních smluv o dodávce investičních celků (smluvními vzory FIDIC, Zásadami mezinárodních obchodních smluv UNIDROIT a Právní příručkou pro tvorbu mezinárodních smluv o dodávce investičních celků vydanou UNCITRAL) a dále instituty pravidelně obsaženými v mezinárodních smlouvách o dodávce investičních celků, zejména ve vztahu k řešení sporů a rozhodčímu řízení. Práce se dále zabývá soutěžně-právní problematikou ve vztahu k mezinárodní dodávce investičních celků. Práce je logicky členěna do pěti kapitol včetně závěru. První kapitola vymezuje základní pojmy - investiční celek, investiční výstavba a mezinárodní smlouva o dodávce investičních celků. Druhá kapitola se věnuje mezinárodním organizacím významným pro úpravu mezinárodních smluv o dodávce investičních celků. Ve třetí kapitole je navázáno analýzou problematiky rozhodčích smluv a prorogačních doložek v mezinárodní investiční výstavbě a mezinárodních smlouvách o dodávce investičních celků. This thesis aims to present the terms industrial works and industrial construction and issues relating to defining them. It furthermore focuses on summarization of characteristics and particularities of selected principal international documents, which deal with the topic of international contracts on supply of industrial works (FIDIC standard forms of contract, UNIDROIT Principles of International Commercial Contracts and Legal Guide on Drawing Up International Contracts for the Construction of Industrial Works issued by UNCITRAL) and regular parts typically contained in the international contracts on supply on supply of industrial works, especially in relation to dispute settlement and arbitration. The thesis furthermore addresses competition law issues relevant to the international supply of industrial works. This thesis is, in logical sequence, divided into five chapters, including the conclusion. The first chapter defines essential terms - industrial works and industrial construction and international contract on supply of industrial works. Second chapter deals with international organisations of importance in respect to international contracts on supply of industrial works.
