Abstract

Institut vnosů a investic v rámci vypořádání společného jmění manželů Diplomová práce Ludmila Tolarová Abstrakt Diplomová práce se zabývá vnosy a investicemi v systematice vypořádání společného jmění manželů. Cílem práce je nejen komplexně vysvětlit fungování vnosů a investic v souvislosti s přelomovými rozhodnutími Nejvyššího a Ústavního soudu, ale také zhodnotit funkčnost a nastavení tohoto institutu i s ohledem na jeho možné praktické dopady. Práce nejprve vysvětluje obsah společného jmění manželů a jeho vypořádání, následně se zabývá současnou úpravu vnosů a investic a nezanedbatelným vlivem judikatury na pojetí tohoto institutu. V závěru jsou zhodnoceny nedostatky právní úpravy a navržena možná řešení předmětných problematických aspektů - změna koncepce společného jmění či způsoby zvýšení informovanosti manželů o právní úpravě manželského majetkového režimu. Institute of contributions and investment within the framework of the settlement of community property of spouses Master thesis Ludmila Tolarová Abstract The master thesis deals with contributions and investments in the system of settlement of community property. The aim of the thesis is not only to provide a comprehensive explanation of the functioning of contributions and investments in the context of the groundbreaking decisions of the Supreme Court and the Constitutional Court, but also to evaluate the functionality and set-up of this institution with regard to its possible practical implications. The thesis first explains the content of the community property and its settlement, then discusses the current regulation of contributions and investments and the influence of case law on the concept of this institute. It concludes by assessing the shortcomings of the legislation and proposing possible solutions to the problematic aspects in question - a change in the concept of community property or ways of increasing spouses' awareness of the legal regulation of the community property. Key words community property, settlement, investment, contribution
