Vybrané problémy humanitárních intervencí

Abstract

Humanitarian interventions, which are usually defined as interventions with the aim of avoiding widespread human suffering, using armed force as a mean of coercion and carried out by a third party on the territory of a state that has not given its consent, raise a number of issues. One of them is also the issue of state sovereignty - among the fundamental elements defining state sovereignty in international politics are the principles of non-interference in the internal affairs of other states and the inviolability of state borders. But is it possible to violate the state's sovereignty in the case when its citizens' human rights are violated and its government does not provide them with sufficient protection against this suffering, and to violate that sovereignty precisely through a humanitarian intervention? The thesis will seek to answer the question of whether a third party can interfere with state sovereignty for the purpose of upholding human rights. The answer will be sought through the presentation of the historical context of humanitarian interventions, the legal perspective, and the concept of human rights, primarily through an analysis of classical concepts of state sovereignty as penned by Jean Bodin, Thomas Hobbes, Jean-Jacques Rousseau, and Carl Schmitt. Humanitární intervence, které bývají definovány jako vojenské operace vedené s cílem zamezit rozsáhlému lidskému utrpení, používající jako donucovací prostředek ozbrojenou sílu a prováděné třetí stranou na území státu, jenž k zákroku neposkytl souhlas, vzbouzí řadu otázek. Jednou z nich je též problematika státní suverenity - mezi základní prvky definující státní suverenitu na poli mezinárodní politiky totiž patří princip nevměšování se do interních záležitostí druhých států a nenarušitelnosti státních hranic. Je ale možné státní suverenitu narušit v případě porušování lidských práv obyvatel státu, jehož vládní reprezentace jim neposkytuje od utrpení dostatečnou ochranu, a tuto suverenitu narušit právě formou humanitární intervence? Práce tak bude hledat odpověď na otázku, zda lze ze strany třetího aktéra státní suverenitu narušit za účelem dodržování lidských práv. Odpověď se bude snažit nalézt jak prostřednictvím představení historického kontextu humanitárních intervencí, právního pohledu a konceptu lidských práv, tak především analýzou klasických pojetí státní suverenity z pera Jeana Bodina, Thomase Hobbese, Jeana-Jacquese Rousseaua a Carla Schmitta. Konečně se pak bude snažit zodpovědět tuto otázku optikou textů Michaela Walzera a Carla Schmitta.
