Abstract

Impeachment of Heads of State in European Parliamentary Systems The impeachment of the head of state, or the threat thereof, is a subject that is often discussed, and which is even employed in presidential and some semi-presidential systems with a strong and politically engaged president, rather than in parliamentary democracies. It is not unexpected that the notion of impeachment within the framework of parliamentarism appears to be predominantly disregarded by jurisprudence and political science which focus (if any) is usually concentrated on the description of domestic legal framework and actual cases of impeachment attempts. Hence, the primary aim of this thesis is to address this research gap by crafting generally applicable theoretical hypotheses based on the provided comparative analysis of six carefully selected European parliamentary republics, namely Albania, Czechia, Ireland, Italy, Poland, and Slovakia, representing various aspects of European legal culture. A conclusion of such a general nature could provide a valuable contribution to the ongoing discourse of the function of the head of state in parliamentary regimes in the context of the present trends towards the rise of populism and illiberalism. Odvolání hlavy státu v evropských parlamentních demokraciích Problematika odvolávání hlavy státu neboli impeachmentu, jeho hrozby, jakož i jeho reálného použití je hojně diskutována v kontextu prezidentských a některých poloprezidentských systémů vyznačujících se silnou a politicky aktivní rolí hlavy státu. V parlamentních systémech jde o téma spíše okrajové. Není proto s podivem, že téma impeachmentu bývá v kontextu parlamentních demokracií často přehlíženo, a to jak v právní vědě, tak i v politologii. Ojedinělé práce na toto téma se zpravidla soustředí na popis domácího právního rámce a na skutečné případy pokusů o odvolání hlav států. Hlavním cílem, který si diplomová práce klade, je překonání nastíněné výzkumné mezery vytvořením obecně použitelných teoretických hypotéz. Toho chce docílit provedením komparativní analýzy šesti vybraných evropských parlamentních republik, a to konkrétně Albánie, České republiky, Irska, Itálie, Polska a Slovenska, které reprezentují různé aspekty evropské právní kultury. Takový obecný výstup by mohl představovat příspěvek doplňující diskuzi o roli hlavy státu v parlamentních republikách v kontextu sílících fenoménů populismu a neliberalismu.
