Abstract

Modifikace společného jmění manželů a genderová nerovnost Abstrakt Tato práce se zabývá právní úpravou společného jmění manželů (SJM) v České republice a jejím vztahem k genderové nerovnosti. Zaměřuje se na to, do jaké míry právní rámec reflektuje socioekonomické rozdíly mezi partnery v manželství a po jeho zániku, přičemž analyzuje, jak strukturální nerovnosti mezi muži a ženami ovlivňují fungování tohoto institutu. Tradiční rozdělení rodinných rolí často vede k tomu, že ženy během manželství přerušují nebo omezují svou pracovní kariéru ve prospěch péče o děti a domácnost, což má dlouhodobé důsledky pro jejich ekonomické postavení a možnosti po rozvodu. Práce se v první části věnuje samotnému institutu SJM, jeho vzniku, obsahu a možnostem jeho zániku. Následně se soustředí na různé majetkové režimy, včetně zákonného režimu a smluvní úpravy majetkových vztahů mezi manžely. Třetí část analyzuje proces vypořádání SJM a jeho dopady na jednotlivé partnery, přičemž zvláštní pozornost věnuje situacím, kdy pečující partner při rozvodu zůstává v ekonomicky nevýhodné situaci. Čtvrtá část se zaměřuje na vliv genderové nerovnosti na SJM a zkoumá, zda právní úprava dostatečně chrání ekonomicky slabšího partnera, jehož profesní a finanční příležitosti byly omezeny kvůli péči o rodinu. Modification of matrimonial property and gender inequality Abstract This thesis examines the legal framework of joint marital property (SJM) in the Czech Republic and its relationship to gender inequality. It explores to what extent the legal system reflects the socio- economic disparities between spouses during marriage and after its dissolution, analyzing how structural gender inequalities impact the functioning of this institution. Traditional gender roles often result in women interrupting or reducing their professional careers to take on caregiving responsibilities, which has long-term consequences for their economic status and financial independence after divorce. The first part of the thesis examines the concept of SJM, its formation, content, and termination. The second part focuses on different property regimes, including the statutory regime and contractual modifications of property relations between spouses. The third section analyzes the process of SJM dissolution and its consequences for individual partners, with special attention to cases where the caregiving spouse remains in an economically disadvantaged position after divorce.
