Abstract

1 Charting the course towards creation of smart cities (legal aspects) Abstract This thesis is focused on the phenomenon of a smart city, which is being used more and more not only in the Czech Republic. Smart city uses the newest technologies for obtaining information about the local community, evaluation of this information, and the subsequent innovative solutions. The topic is not yet thoroughly legally elaborated, which is why the aim of this thesis is to create the first insight to smart city from the legal perspective. The thesis is divided into four chapters, each about selected partial aspects of a smart city. Given the broad extent of a smart city, the chosen topics are the ones, which resonate in smart city in the year 2025 the most. The first part of this thesis is dedicated to defining what a smart city generally represents and what reflection in law it has. It includes the statement that smart city solutions fall under the independent competences of a municipalities not only in the Czech Republic. The second part explains the relationship between smart city and data protection, which sets out the first legal limitation for a smart city. Směrem k vytvoření smart cities (právní aspekty) Abstrakt Tato práce se zabývá fenoménem smart city, který je využíván čím dál více obcemi nejenom v České republice. Smart city využívá nejnovější technologie ke zjišťování informací o daném místně určeném společenství osob, k hodnocení takto získaných poznatků a pro následná inovativní řešení. V současnosti není toto téma zevrubněji právně zpracováno, a proto cílem této práce je vytvořit první vhled do smart city právním pohledem. Práce je rozdělená celkem do čtyř kapitol, ve kterých je věnována pozornost vybraným dílčím aspektům smart city. Vzhledem k rozsáhlosti smart city byla vybrána témata, která rezonují smart city v roce 2025 nejvíce. První část práce se věnuje vymezení, co smart city v obecné rovině představuje a jaký odraz v právu přináší. Jde zejména o stanovení, že smart city řešení spadají nejenom v České republice pod samostatnou působnost obcí. Druhá část se věnuje vztahu smart city a ochrany osobních údajů, která tvoří první právní limit pro smart city. Obce využívající smart city řešení mohou zpracovávat osobní údaje, ale musejí mít zákonný důvod k jejich zpracování. Práce ukazuje, že samotné přihlášení se obce ke smart city ale nemůže naplnit podmínky zákonnosti zpracování osobních údajů ani dle GDPR ani v souvislosti s domácí právní...
