Náhradní mateřství a sociální ochrana

Abstract

The diploma thesis concerns the issue of surrogacy as viewed from the perspective of social protection of individual participants of this institute. The primary objective is to analyze and evaluate the current legal framework of the Czech Republic, which currently lacks specific legislation in this area, and identify its weaknesses. Based on those findings, the thesis critically evaluates the potential future legislation in this area. The core of the thesis regards the analysis of applicable legal instruments, relevant judicature, literature, comparison with selected foreign legislation, and specifically, the evaluation of the surrogacy analysis that was issued by the Czech Ministry of Justice in 2024. The 2024 analysis, outcomes of which were taken into account by the government of the Czech Republic and that should be the basis of the legislation regarding surrogacy in the future, signals significant progress for the legislative work in the area of surrogacy in the Czech Republic and can be seen as the historically first effort to pass a comprehensive legislative act regarding this institute. Diplomová práce se věnuje problematice náhradního mateřství z pohledu sociální ochrany jednotlivých účastníků tohoto institutu. Hlavním cílem práce je analyzovat a zhodnotit současný právní rámec v České republice, který v této oblasti stále postrádá výslovnou právní úpravu, a identifikovat jeho slabá místa. V kontextu těchto zjištění pak kriticky zhodnocuje východiska budoucí právní úpravy. Práce je postavena na analýze platných právních předpisů, relevantní judikatury, odborné literatury, srovnání s vybranými zahraničními právními řády a zejména na zhodnocení analýzy institutu náhradního mateřství, kterou v roce 2024 zpracovalo Ministerstvo spravedlnosti. Právě tato analýza, jejíž závěry byly vzaty vládou na vědomí a jež má sloužit jako podklad pro budoucí legislativní úpravu, představuje zásadní posun v oblasti právního ukotvení náhradního mateřství v České republice a představuje první komplexní pokus o úpravu tohoto institutu. V rámci české právní úpravy je pojednáno o jednotlivých institutech chránících sociální práva zúčastněných osob.
