Právní aspekty jezdeckého sportu

Abstract

1 Abstract This thesis deals with the current legal regulation of equestrian sport in the Czech Republic. With the growing popularity of equestrianism and the increasing number of horses, the need for deeper legal awareness among participants in this sport, especially among riders and horse owners, is also rising. The thesis provides a comprehensive overview of the legal regulation in the key legislation and links the regulation with examples from practice, pointing out the shortcomings of this regulation and proposing possible solutions for more effective regulation of equestrian sport, which would contribute to greater clarity of the legislation and better protection of horses in equestrian sport. For these purposes, the thesis is systematically divided into five chapters. The first chapter offers a brief introduction to the key legislation governing various areas of equestrian sport and highlights the existence of non-legal rules and regulations issued by equestrian organizations, which are the rules and decisions of the Czech Equestrian Federation (Česká jezdecká federace). Tato diplomová práce se zabývá současnou právní úpravou jezdeckého sportu v České republice. S rostoucí popularitou jezdectví a narůstajícím počtem koní se zvyšuje i potřeba hlubšího právního povědomí mezi účastníky tohoto sportu, zejména mezi jezdci a majiteli koní. Práce poskytuje ucelený přehled právní úpravy v klíčových právních předpisech a úpravu propojuje s příklady z praxe, na základě čehož poukazuje na nedostatky této úpravy a navrhuje možná řešení pro efektivnější regulaci jezdeckého sportu, která by přispěla k vyšší srozumitelnosti právních předpisů a lepší ochraně koní v rámci jezdeckého sportu. Za těmito účely je práce systematicky členěna do pěti kapitol. První kapitola nabízí stručné představení klíčových právních předpisů upravujících různé oblasti jezdeckého sportu a poukazuje na existenci neprávních pravidel a předpisů vydávaných jezdeckými organizacemi, jimiž jsou pravidla a rozhodnutí České jezdecké federace. V druhé kapitole je pozornost soustředěna na organizaci jezdeckého sportu a chovu koní, s důrazem na roli orgánů státní správy, chovatelských svazů a jezdeckých organizací.
