Abstract

EU Biodiversity Strategy 2030 and legal instruments for its implementation in the Czech Republic Abstract The thesis focuses on the analysis of the current EU conceptual document in the field of protection and restoration of biodiversity - the EU Biodiversity Strategy for 2030 and its implementation into the Czech legal system. In the introductory part of the thesis, the substantive and legal foundations of biodiversity protection at the global and EU level are outlined. Afterwards, specific strategic objectives related to nature conservation and restoration, procedural tools necessary for effective implementation of the strategy and the role of the EU in biodiversity protection at the international level are presented. The thesis further analyses (selected) relevant secondary legal instruments that are essential tools for the implementation of the conceptual objectives and attempts to identify some concrete steps that need to be taken at EU level to achieve the set objectives. Final chapter of the thesis provides an overview of the sources of Czech environmental law that reflect the objectives of the EU strategy and suggests potential improvements de lege ferenda. Strategie EU v oblasti biologické rozmanitosti do roku 2030 a právní nástroje její implementace v ČR Abstrakt Kvalifikační práce se zabývá rozborem aktuálního koncepčního dokumentu EU v oblasti ochrany a obnovy biologické rozmanitosti - Strategií EU do roku 2030 a jejím promítnutím do právního systému České republiky. V úvodní části práce jsou nastíněny věcné a právní základy ochrany biodiverzity na celosvětové i unijní úrovni, které jsou následovány představením konkrétních strategických cílů týkajících se ochrany a obnovy přírody, procesních nástrojů nutných pro efektivní implementaci strategie a úlohy EU při ochraně biodiverzity na mezinárodní úrovni. Pozornost je dále věnována analýze (vybraných) relevantních nástrojů sekundárního práva, které jsou zásadním nástrojem provádění koncepčních cílů a pokouší se identifikovat některé konkrétní kroky, které je třeba na unijní úrovni provést, aby bylo vytyčených cílů dosaženo. Závěrečná kapitola práce analyzuje prameny práva životního prostředí v České republice, které odrážejí cíle unijní strategie a navrhuje možné změny de lege ferenda.
