Transpozice Směrnice o kolektivních žalobách

Abstract

The thesis deals with the transposition of Directive (EU) 2020/1828 of the European Parliament and of the Council on representative actions for the protection of consumers' collective interests into the Czech legal system. It focuses on the institution of collective actions for the issuance of remedies, which represents a fundamental novelty for Czech procedural law. The thesis traces the process of adoption of the Directive at the EU level, including the origin of the adopted amendments, presents an overview of the reasons for the adoption of the Directive and an overview of the transposition status in individual Member States. Furthermore, the thesis deals with the theoretical definition of the obligation to transpose directives and the individual consequences of the failure of Member States to fulfil this obligation, including the application to the specific situation of the Czech Republic's failure to fulfil its transposition obligation. In this part of the thesis the question of the possibility of direct effect of the Directive is addressed. The prediction of possible practical consequences for a potential class action case in Czech Repiblic is illustrated by two model examples. Diplomová práce se zabývá transpozicí směrnice Evropského parlamentu a Rady (EU) 2020/1828 o zástupných žalobách na ochranu kolektivních zájmů spotřebitelů do českého právního řádu. Zaměřuje se na institut hromadných žalob na vydání opatření ke zjednání nápravy, který představuje zásadní novinku pro české procesní právo. Práce sleduje proces přijetí Směrnice na úrovni Evropské unie, včetně původu přijatých pozměňovacích návrhů, předkládá přehled důvodů pro přijetí Směrnice a rámcový přehled stavu transpozice v jednotlivých členských státech. Dále se práce věnuje teoretickému vymezení povinnosti transpozice směrnic a jednotlivým důsledkům nesplnění této povinnosti členskými státy, včetně aplikace na konkrétní situaci nesplnění transpoziční povinnosti Českou republikou. V této části práce je mj. krátce řešena otázka možnosti přímého účinku Směrnice. Predikce možných praktických důsledků pro potenciální hromadnou kauzu je ilustrována na dvou modelových příkladech. Další část práce analyzuje dosavadní právní úpravu hromadných žalob v České republice, přičemž zohledňuje předchozí instituty s prvky hromadnosti obsažené v českém právním řádu do roku 2023 a také krátce zmiňuje recentní osud kauzy Dieselgate v České republice.
