Abstract

Criminality related to substance abuse Abstract This thesis examines the issue of primary drug crime, which is one of the potential types of crime related to substance abuse. The thesis is divided into six parts. In the first part, the author defines the concept of addictive substances from both medical and legal perspectives, within the context of the legal system of the Czech Republic, including narcotic drugs, psychotropic substances, and drugs. The second part discusses the relationship between drugs and crime and categorizes drug crimes based on these relationships. The third part examines the international and EU regulations related to drug trafficking. The author summarizes the development of the international drug control system, analyzes relevant aspects of the current global treaty system from a criminal law perspective, and discusses the harmonization of certain drug offenses, the early warning system, and the functioning of the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA) in the EU. The fourth part titled "Drugs and Drug Crime in the Czech Republic," discusses the current strategy of drug policy, the drug situation in the Czech Republic, and the position of drug crime within the broader context of overall crime. Trestná činnost související se zneužíváním návykových látek Abstrakt Předmětem této diplomové práce je problematika primární drogové kriminality jako jednoho z možných druhů trestné činnosti páchané v souvislosti se zneužíváním návykových látek. Práce je členěna do šesti částí. V první části práce autor vymezuje pojem návykových látek v medicínském i právním pojetí v kontextu právního řádu České republiky, omamných a psychotropních látek a drog. Ve druhé části se autor zabývá vztahem mezi drogami a kriminalitou a dělením drogové trestné činnosti vycházející z těchto vzájemných vztahů. Třetí část práce je věnována mezinárodněprávní a unijní úpravě nakládání s drogami. Autor zde shrnuje vývoj mezinárodního systému kontroly drog a analyzuje zejména ty aspekty současného globálního smluvního systému, které jsou významné z hlediska trestního práva. Stran unijní úpravy se autor zaobírá jednak harmonizací některých drogových trestných činů, systémem včasného varování a fungováním Evropského monitorovacího střediska pro drogy a drogovou závislost (EMCDDA).
