Abstract

Enhanced Cooperation in the European Union Abstract The master's thesis aims to analyse the mechanism of enhanced cooperation in a comprehensive way. The theoretical part of the work presents the issue of flexible and differentiated integration. The basic terminology is outlined here, which is followed by an introduction to the theoretical concepts of flexible development of the integration process and the subsequent systematic classification of the enhanced cooperation mechanism. The remaining four chapters deal with the mechanism of enhanced cooperation itself as it is one of the EU's main instruments for flexible integration. The second chapter deals with the historical development of enhanced cooperation, focusing on the provisions of the Amsterdam Treaty in particular, which introduced this legal mechanism for the first time, and the subsequent changes in the provisions that came into force with the Treaty of Nice. The following chapter concerns the legal analysis of the substantive and procedural rules of enhanced cooperation according to the applicable EU law. It also deals with enhanced cooperation in the field of the Common Foreign and Security Policy and its differences compared to the current regime and the mechanism of the so-called permanent structured cooperation (PESCO). Posílená spolupráce v Evropské unii Abstrakt Diplomová práce si klade za cíl komplexním způsobem zmapovat institut posílené spolupráce. Teoretická část práce blíže představuje problematiku flexibilní, resp. diferencované integrace. Je zde vytyčena základní terminologie, na kterou navazuje přiblížení základních teoretických koncepcí flexibilního vývoje integračního procesu a následné systematické zařazení institutu posílené spolupráce. Zbylé čtyři kapitoly se již věnují samotnému právnímu institutu posílené spolupráce jako jednomu z hlavních nástrojů EU v rámci flexibilní integrace. Druhá kapitola se zabývá historickým vývojem tohoto institutu, přičemž se věnuje zejména ustanovením Amsterodamské smlouvy, která tento právní institut poprvé výslovně zavedla, a následným změnám v ustanoveních, ke kterým došlo s účinností Niceské smlouvy. Následující kapitola se poté věnuje právnímu rozboru hmotněprávních a procesních pravidel institutu posílené spolupráce podle platné právní úpravy. Taktéž se věnuje posílené spolupráci v oblasti společné zahraniční a bezpečnostní politiky a jejím rozdílům oproti běžnému režimu a mechanismu tzv. stálé strukturované spolupráce.
