Abstract

The line between corruption and lobbying Abstract The rigorous thesis answers the question if there there is any difference between corruption and lobbying and if so, where this boundary lies. In her work, the author first focuses on the most serious problem of today's society, the issue of corruption. Since this phenomenon is so broad, it would be almost impossible to cover it in one work, this work therefore focuses on the corruption from the perspective of criminal law. The first main part of the work is divided into five chapters. The first chapter of the work deals with corruption in general and primarily tries to define the concept of corruption as such, the causes of its emergence and demonstrate the diversity of its forms. The chapter also lists concepts related to corruption. The second chapter devotes a brief historical excursion. The following third chapter focuses on the international regulation of corruption. The fourth chapter will introduce the current criminal law regulation of corruption. The chapter five deals with the detection of corruption, selected tools for combating corruption and, above all, deals with the analysis of the punishment of corrupt activities from the perspective of the courts. Hranice mezi korupcí a lobbingem Abstrakt Rigorózní práce odpovídá na otázku, zda existuje nějaký rozdíl mezi korupcí a lobbingem a kde příp. leží tato hranice. Ve své práci se autorka nejprve věnuje nejzávažnějšímu problému dnešní společnosti, problematice korupce. Jelikož je to fenomén natolik široky, bylo by až nemožné to postihnout v jedné práci, tato práce se proto zaměřuje na trestněprávní problematiku tohoto pojmu. První stěžejní část práce se dělí na pět kapitol. První kapitola práce se věnuje korupci v obecné rovině a primárně se snaží vymezit pojem korupce jako takový, příčiny jeho vzniku a demonstrovat rozmanitost jeho forem. V kapitole jsou uvedeny i pojmy s korupcí související. Kapitola druhá se poté věnuje stručnému historickému exkurzu. Následující třetí kapitola se soustředí na mezinárodní úpravu korupce. Další čtvrtá kapitole přibližuje současnou trestněprávní úpravu korupčních deliktů. Kapitola pátá se zabývá odhalováním korupce, vybranými nástroji boje proti korupci, především analýzou trestání korupčních aktivit pohledem soudů. V poslední kapitole nechybí statistické údaje. Druhá stěžejní část se zabývá pojmem lobbingu. Dělí se na čtyři kapitoly. Šestá kapitola se věnuje pojmu lobbingu v obecné rovině a vymezuje její druhy a formy.
