Duhové rodiny v přeshraničních situacích z pohledu soudů

Abstract

The dissertation thesis deals with the case law concerning rainbow families in cross-border situations. The main aim of the thesis is to describe, analyse and categorise the relevant case law of the European Court of Human Rights, the Court of Justice of the European Union and the Czech courts, while focusing on its implications and on the relationship between the European and national courts. The core of the thesis is an comprehensive overview of the case law of these courts, followed by an analysis of their mutual interactions. The dissertation thesis thus explains, in a complex manner, how the case law on the rainbow families' rights in cross-border situations operates within the multi-level judicial system.

Disertační práce se zabývá judikaturou týkající se duhových rodin v přeshraničních situacích. Hlavním cílem práce je zmapovat, zanalyzovat a kategorizovat relevantní judikaturu Evropského soudu pro lidská práva, Soudního dvora Evropské unie a českých soudů, a to se zaměřením na její důsledky a na vztahy mezi evropskými a vnitrostátními soudy. Jádro práce představuje rozbor judikatury uvedených soudů, na nějž navazuje analýza jejich vzájemných interakcí. Disertační práce tak komplexně vysvětluje, jak judikatura k právům duhových rodin v přeshraničních situacích funguje v rámci víceúrovňového systému soudů.
