Abstract

Gender equality and discrimination in the European court of Justice case law Abstract This thesis deals with the legal regulation of the European Union and the related case law of the Court of Justice in the field of equality and anti-discrimination on the basis of sex in social security law. The aim of this thesis is to provide a basic overview of the currently valid EU legal regulation in this area, focusing mainly on secondary law of the European Union and linking it with a selection of relevant case law of the Court of Justice from the 21st century. The thesis is divided into an introduction, two separate parts and a conclusion. In the first part, which is further divided into individual points and related subpoints, I focus on defining the basic concepts and principles central to this thesis (equality, discrimination, the principle of equal treatment and anti-discrimination) and their division into types. The concepts of gender and gender mainstreaming are also included. Furthermore, the institute of positive measures is introduced and, from the field of procedural law, the institute of the shifted burden of proof. Rovnost a zákaz diskriminace v judikatuře SDEU se zaměřením na diskriminační důvod pohlaví Abstrakt Tato práce se zabývá právní úpravou Evropské unie a k ní se pojící judikaturou Soudního dvora v oblasti rovnosti a zákazu diskriminace na základě pohlaví v právu sociálního zabezpečení. Cílem této práce je přinést základní přehled současně platné unijní právní úpravy této oblasti se zaměřením zejména na sekundární právo Evropské unie a provázat ji s výběrem relevantní judikatury Soudního dvora z 21. století. Práce je rozdělena na úvod, dvě samostatné části a závěr. V první části, která je dále rozdělena na jednotlivé body a z nich vyplývající podbody, se věnuji vymezení základních pojmů a zásad stěžejních pro tuto práci (rovnost, diskriminace, zásada rovného zacházení a zákazu diskriminace) a jejich dělení na jednotlivé typy. Zahrnuty jsou také pojmy gender a gender mainstreaming. Dále je představen institut pozitivních opatření a z oblasti procesního práva také institut přeneseného důkazního břemene. Pozornost je zaměřena na ustanovení platné unijní úpravy týkající se výše zmíněných pojmů a institutů, která jsou doprovázena stručným přehledem relevantní judikatury Soudního dvora věnující se výkladu těchto ustanovení.
