Abstract

1 Providing Health Services to a Pediatric Patient ABSTRACT The presented thesis focuses on the legal aspects of providing health services to pediatric patients in the Czech Republic. The central attention is on the minor child as a vulnerable person, entitled to special legal protection and an appropriately tailored approach from health service providers. The work gradually defines the basic concepts related to the legal status of minors, their parents, and other individuals who may represent the child in healthcare matters. Key topics primarily include issues related to treatment decisions, including the matter of informed consent and situations where care is provided without consent. Attention is also given to judicial interventions, such as in cases of conflict between the views of parents and the child, or when health protection is necessary. Another section of the work addresses the rights of pediatric patients during hospitalization, including the right to continuous presence of a guardian, the right to visits and contact with the outside world, the right to information, and the possibilities for their limitation in specific situations. Poskytování zdravotních služeb dětskému pacientovi ABSTRAKT Předkládaná rigorózní práce se zaměřuje na právní aspekty poskytování zdravotních služeb dětskému pacientovi v České republice. V centru pozornosti stojí nezletilé dítě jakožto zranitelná osoba, které náleží zvláštní právní ochrana i přiměřeně uzpůsobený přístup ze strany poskytovatelů zdravotních služeb. Práce postupně vymezuje základní pojmy týkající se právního postavení dětského pacienta, rodičů a dalších osob, které mohou dítě v oblasti péče o zdraví zastupovat. Stěžejní témata tvoří především otázky rozhodování o léčbě, včetně problematiky informovaného souhlasu a případů, kdy je péče poskytována i bez souhlasu. Pozornost je tak věnována soudním intervencím, například v případech rozporu mezi stanovisky rodičů a dítěte nebo při nutnosti ochrany zdraví. Další část práce se věnuje právům dětských pacientů během hospitalizace, jako je zejm. právo na nepřetržitou přítomnost, právo na návštěvy a kontakt s vnějším světem, právo na informace, a rovněž možnostem jejich omezení ve specifických situacích. Závěrečná kapitola práce se soustřeďuje na postup při podezření na týrání, zanedbávání nebo zneužívání dítěte (tzv. syndrom CAN).
