Abstract

The death penalty in the light of international law and practice in Vietnam Abstract This thesis is dealing with the death penalty, beginning by defining the concept of punishment and its purpose. It then looks into the historical development of the death penalty and how it has evolved over time, showing how this institution has changed throughout history. The thesis then examines how the death penalty is regulated under international law, analysing key international treaties such as the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and its Second Optional Protocol, the Convention against Torture or the Geneva Conventions and their Additional Protocols. These documents form the basic legal framework for the regulation of the death penalty, specifying when it can be applied and aiming to limit or abolish it. The thesis also looks into the case law of the United Nations Human Rights Committee, which offers interpretations of the International Covenant on Civil and Political Rights and provides significant recommendations on the issue of the death penalty. Trest smrti ve světle mezinárodního práva a praxe ve Vietnamu Abstrakt Tato diplomová práce se zabývá trestem smrti, přičemž na začátku definuje pojem trestu a jeho účel. Následně analyzuje historii trestu smrti a jeho vývoji v průběhu dějin, přičemž lze pozorovat, jak se tento institut v průběhu dějin výrazně měnil. Následně se práce zaměřuje na právní úpravu trestu smrti v mezinárodním právu, přičemž analyzuje klíčové mezinárodní smlouvy, jako je Všeobecná deklarace lidských práv, Mezinárodní pakt o občanských a politických právech a jeho Druhý opční protokol, Úmluva proti mučení či Ženevské úmluvy s jejich Dodatkovými protokoly. Tyto dokumenty tvoří základní právní rámec pro regulaci trestu smrti, stanovují podmínky jeho uplatňování a směřují k jeho omezení nebo zrušení. Práce se rovněž zabývá judikaturou Výboru OSN pro lidská práva, která interpretuje Mezinárodní pakt o občanských a politických právech a poskytuje důležitá doporučení týkající se problematiky trestu smrti.
