Abstract

Mezinárodní obchod a investice v energetice Abstrakt Tato rigorózní práce se zabývá mezinárodním obchodem a investicemi v energetice, což je široké a mnohodimenzionální téma. Obsahuje mj. popis mechanismů fungování trhu s komoditami a specifika kontraktace v dané oblasti, analýzu vlivu energetiky na globální politiku a na jednotlivé národní ekonomiky, zabývá se využitím arbitráže v dané oblasti, definuje stěžejní právní i ekonomické pojmy, pojednává o historii energetických zdrojů i způsobu jejich využívání a propojuje jednotlivé relevantní obory. Systematicky je rozdělena na tři části, kdy v první části je pojednáváno o energetice obecně, o její definici a historii, jejím vývoji i právní regulaci. Druhá část se týká mezinárodního obchodu v energetice, přibližuje tento pojem jako takový, a dále detailně popisuje její mezinárodní právní úpravu, specifika obchodování s energetikou z ekonomického hlediska i vliv energetiky na životní prostředí. Část třetí se zabývá investicemi v energetice, definicí relevantních pojmů, vztahu mezinárodních smluv a práva EU, právními standardy ochrany investic, řešením sporů, odstoupením od Smlouvy o energetické chartě a doložkou Sunset Clause. International trade and investments in the energy sector Abstract This thesis deals with international trade and investments in the energy sector, a broad and multidimensional topic. It includes, among others, a description of the mechanisms of commodity market functioning and the specifics of contracting in this field, an analysis of the impact of energy sector on global politics and on individual national economies, it deals with the use of arbitration in this field, defines key legal and economic concepts, covers the history of energy resources and the way they are used, and links the various relevant disciplines. It is systematically divided into three parts, with the first part dealing with energetics in general, its definition and history, its development and its legal regulation. The second part covers international energy trade, introducing the concept as such, as well as analyzing its international legal regulation in detail, the specifics of energy trade from an economic point of view and the impact of the energy industry on our environment.
