Abstract

Labor law aspects of labour performed outside the employer's workplace Abstract This thesis, entitled Labor law aspects of labour performed outside the employer's workplace, deals with the problem of atypical employment in the form of remote work. The basic topics described are current regulations contained especially in paragraph § 317 Czech Labour Code, including its reflections on historical connotation and European Union law. The aim of the thesis is to provide a comprehensive view on the issue of labour performed outside the employer's workplace and to analyse the current state of present legislation in the Czech Republic in its full scope with recent changes. At the same time, the requirements of European Union law have been reflected in national legislation. In order to achieve this goal, methods of literary research, analysis and comparison have been used in the processing of the thesis. The main task was to analyse and document the current state of legislation. Pracovněprávní aspekty práce konané mimo pracoviště zaměstnavatele Abstrakt Výše obsažená diplomová práce s názvem Pracovněprávní aspekty práce konané mimo pracoviště zaměstnavatele pojednává o problematice atypického zaměstnání v podobě distanční práce. Základními popisovanými tématy jsou aktuální platná úprava obsažená zejm. v ustanovení § 317 ZPr včetně jejích reflexí historických a uplatnění prvků evropského práva. Diplomová práce si klade za cíl poskytnout komplexní vhled do problematiky výkonu závislé práce konané mimo pracoviště zaměstnavatele a zanalyzovat současný stav platné právní úpravy v České republice v jejím plném rozsahu. Zároveň jsou reflektovány požadavky práva Evropské unie na národní právní řád a částečně jimi vynucené probíhající změny tuzemské legislativy. K dosažení stanoveného cíle byly při zpracovávání práce využity metody literární rešerše, analýzy a srovnávání. Hlavním úkolem bylo analyticky zachytit a zdokumentovat současnou podobu právní úpravy.
