Abstract

1 Abstrakt: Právní úprava myslivosti ve vztahu k environmentálně udržitelnému zemědělství a lesnictví Předložená práce se v rozsahu úvodu, pěti hlavních kapitol a závěru zaobírá aktuálním tématem myslivosti ve vztahu environmentálně udržitelnému zemědělství a lesnictví. Zákon o myslivosti by měl být v nejbližší budoucnosti opět novelizován, a to poměrně zásadně. Poslanecká sněmovna má na podzim 2024 v prvním čtení projednat sněmovní tisk 732/0, který obsahuje změny tak, jak je připravilo Ministerstvo zemědělství ČR. Připravená novela má řadu podporovatelů i kritiků. Není pochyb o tom, že aktuálně platná právní úprava potřebuje změnu. Otázkou ale zůstává, zda zrovna takovouto formou a zda by nebylo na místě předložit návrh zcela nové legislativy, jejímuž vytvoření by ale měla předcházet srozumitelná koncepce, a to nejen v oblasti myslivosti, ale i fakticky navazujícím lesnictví a zemědělství. Aktuální neutěšený stav české myslivosti je velmi ovlivněn lesnickým a zemědělským hospodařením za komunistického režimu, kdy řada negativních jevů z té doby přetrvává dodnes. Jedním z nejzásadnějších faktorů, které se na stavu české přírody a krajiny podepsaly, byl koncept kolektivizace. Během tohoto procesu došlo v podstatě k likvidaci venkova a soukromého zemědělství a také k nezhojitelnému zpřetrhání vztahů...

1 Abstract: Legal regulation of hunting in relation to environmentally sustainable agriculture and forestry The presented thesis, in the scope of the introduction, five main chapters and the conclusion, deals with the current topic of hunting in relation to environmentally sustainable agriculture and forestry. The Hunting Act should be amended again in the near future, and quite fundamentally. In fall of 2024, the Chamber of Deputies is to discuss Parliamentary Press 732/0 in the first reading, which contains the changes as prepared by the Ministry of Agriculture of the Czech Republic. The prepared amendment has a number of supporters, as well as critics. There is no doubt that the current legislation needs to be changed. The question remains, however, whether in such form and whether it would not be appropriate to present a proposal for completely new legislation, the creation of which should be preceded by an understandable concept, not only in the field of hunting, but also in fact related forestry and agriculture.
