Abstract

Problematika právní regulace dezinformační činnosti Abstrakt Tato diplomová práce se zabývá problematikou dezinformací, jejich šířením a právní regulací, se zaměřením na kritiku různých nástrojů boje proti dezinformacím. Dezinformace, jako fenomén moderní digitální éry, mohou představovat vážné ohrožení demokratických procesů, veřejného zdraví a bezpečnosti státu. Práce se dělí do několika částí. První část zkoumá podstatu dezinformací, jejich typické znaky, platformy, které jsou využívány pro jejich šíření, a psychologické aspekty, které ovlivňují, jak jsou dezinformace přijímány a šířeny. Druhá část analyzuje společenskou škodlivost dezinformační činnosti, se zaměřením na její dopady na svobodnou politickou soutěž, veřejné zdraví a bezpečnost státu. Následující část se věnuje právním aspektům omezení svobody projevu, porovnává české ústavní právo s Evropskou úmluvou o ochraně lidských práv a základních svobod, a rozebírá relevantní judikaturu Evropského soudu pro lidská práva. Závěrečná část práce se soustředí na nástroje boje proti dezinformacím, analyzuje současnou právní úpravu v České republice, přístupy na evropské úrovni, včetně Nařízení o digitálních službách (DSA), a porovnává legislativní opatření v jiných evropských státech. The Issue of Legal Regulation of Disinformation Activity Abstract This thesis addresses the issue of disinformation, its dissemination, and legal regulation, with a focus on critiquing various tools used in the fight against disinformation. As a phenomenon of the modern digital era, disinformation may pose a serious threat to democratic processes, public health, and state security. The thesis is divided into several parts. The first part explores the nature of disinformation, its typical characteristics, the platforms used for its dissemination, and the psychological aspects that influence how disinformation is received and spread. The second part analyzes the social harm caused by disinformation activities, focusing on its impact on free political competition, public health, and state security. The subsequent section examines the legal aspects of restricting freedom of expression, comparing Czech constitutional law with the European Convention on Human Rights, and discussing relevant case law of the European Court of Human Rights. The final part of the thesis focuses on tools to combat disinformation, analyzing the current legal framework in the Czech Republic, approaches at the European level, including the Digital Services Act, and comparing legislative measures in other European countries.
