Společné jmění manželů a podnikání

Abstract

Tato práce je věnována, jak se již ze samotného názvu podává, problematice vztahů mezi manžely z hlediska majetkoprávního. Klade si za cíl zmapovat a analyzovat specifické vztahy jak mezi manžely navzájem (tedy uvnitř manželství), tak navenek vůči třetím osobám, vyložit právní podstatu majetkového společenství a jeho fungování, nastínit charakteristické rysy právní úpravy ve světle judikatury a soudní praxe. Do své práce se pokusím pojmout nejen teoretická a praktická východiska platné právní úpravy, nýbrž i určité úvahy de lege ferenda. S ohledem na pokročilý stav prací na nové občanskoprávní kodifikaci považuji za nutné, zmínit se několika slovy rovněž o uvažované budoucí právní úpravě manželských majetkových vztahů. Účelem této práce není postihnout celou problematiku SJM, neboť jde o problematiku, ač to na první pohled nemusí být zcela zřejmé, značně rozsáhlou, a proto bych se chtěla zaměřit jen na určité aspekty tohoto právního institutu - SJM ve vztahu k podnikání. Práce je rozdělena na čtyři základní části. Prvou je historická studie vývoje těchto vztahů na našem území od dob, kdy zásadní roli v těchto vztazích hrálo zvykové právo a poté právo církevní, až do současné úpravy provedené zákonem č. 91/1998 Sb. Resumé The topic of this thesis was called "The estate by the entirety and the enterprise". As it is obvious from the title, the discourse deals with the legal adaptation of property relations between husbands in connection with undertaking no matter whtether carry on business one's or both. Simultaneously it deals with the problems of the protection of the party that is weaker economically or in other way. No less target of importace is protection the third party as well. Odds are that this dissertation on the theme of community does not contain all matters dealing with because matrimonial law of property covers so extensive area that every indivivual aspekt of this specific kind of property partnership would appertain essay. It would be posiible to write paper on this topic about much more pages but that wasn't the aim. The object consisted in creation certain summmary and vignette here of institute. My dissertation targets the spousal joint ownership being influenced and threatened by a spouse-businessman. But it's the only one visual angle on this problem. On the other hand also community can have an averse effet on undertaking.
