Abstract

Domácí porody v českém právním řádu Abstrakt Tato diplomová práce nazvaná "Domácí porody v českém právním řádu" se zaměřuje na aktuální právní rámec domácích porodů v České republice. Přestože každým rokem počet dětí narozených v domácím prostředí stoupá, stále v našem právním systému chybí specifická úprava tohoto práva. Současný stav je nežádoucí zejména z pohledu postavení rodičky, a to za stavu, kdy trestní soudy již shledaly rodičku trestně odpovědnou za volbu místa, kde potomka přivede na svět. Autorka v osmi kapitolách práce zkoumá místa, kde ženy v České republice přivádí děti na svět, zakotvení práva na volbu místa porodu, práva a povinnosti rodičky, postavení nenarozeného dítěte a roli porodních asistentek a dul. Porodním asistentkám není dosud umožněno pomáhat u domácích porodů. Tento postoj České republiky byl napaden u Evropského soudu pro lidská práva. Tento soud ale státům přiznal v této oblasti široký prostor pro uvážení, ze kterého podle dotyčného soudu Česká republika nijak nevybočila. Ženy v ČR se tím pádem nachází v situaci, kdy na jedné straně mají garantované právo na výběr místa porodu, ale na straně druhé jim je odepírána profesionální pomoc. Home births in the Czech legal system Abstract This thesis titled "Home Births in the Czech Legal System" focuses on the current legal framework for home births in the Czech Republic. Despite the increasing number of children born at home each year, there is still a lack of specific regulations regarding this right in our legal system. The current situation is particularly undesirable from the perspective of the mother's status, especially when criminal courts have already found mothers criminally responsible for choosing the place where they give birth. The author, in eight chapters, examines the places where women in the Czech Republic give birth, the right to choose the place of birth, the rights and obligations of the mother, the status of the unborn child, and the roles of midwives and doulas. Midwives are not yet allowed to assist with home births. This stance of the Czech Republic has been challenged at the European Court of Human Rights. However, the court granted states a wide margin of discretion in this area, which, according to the court, the Czech Republic did not exceed.
