Abstract

Hazardní hry z pohledu obcí Abstrakt Tato diplomová práce se zabývá problematikou hazardních her a jejich vztahu k obcím. Práce je uvozena krátkým kontextem popisující stav hazardních her za předchozí právní úpravy a vlivu obcí na existenci herních prostor na vlastním území v tomto období. Hlavní částí je rozbor činnosti obcí v samostatné působnosti. Zde je rozebrána normotvormá činnost obcí spolu s jejími korektivy a rozbor judikatury vzešlé v návaznosti na praktické fungování právních předpisů vytvořených obcemi. Mimo plošné zákazy hazardních her jsou zde prozkoumávány alternativní způsoby jejich regulace skrze samosprávnou činnost obcí. Prezentován je například koncept no-go zón vytyčujících oblasti obecního území, na kterých nesmí být hazardní hry provozovány, zatímco na území obce, které takto stiženo není, provozovány být mohou. S podobnou premisou je uveden opačný princip go-to zón. Mimo potlačování hazardu je v této části rovněž analyzován opačný směr smýšlení místní samosprávy, a to podpora hazardních her na vlastním území. Za způsoby, které jsou pro to možné a po právu, byly vybrány vlastní podnikání obce, jakožto provozovatele hazardních her a obcí zřízená právnická osoba podnikající v odvětví hazardních her se zástupcem obce ve vedení této právnické osoby. Gambling from the perspective of municipalities Abstract This thesis sets its interest on the relationship between gambling and municipalities. The thesis starts off with short contextual description of the state of gambling during former law regulation and describes the influence of municipalities on the creation of gambling facilities in their jurisdiction. The center of the thesis is set on the analysis of acts of municipalities in their own governance. There is an analysis of the creation of law regulation by the municipalties together with its limiting factors and an analysis of jurisprudence formed as the answer of application of said regulation. The manner in which a regulation is looked on is not only by the premise of blanket ban of gambling, but also with an alternative way of setting limits to it. A concept of so- called "no-go zone" is presented, in which the municipality sets areas of its own jurisdiction as a place, where there is forbidden for gambling to take root, whereas on the rest of the municipality's jurisdiction, there is no effect put on gambling facilities. There is an opposite concept too, a so-called "go-to zone", which is presented in said section.
