Abstract

Role prezidenta republiky při jmenování, přijímání demise a odvolávání vlády, jejího předsedy a členů Abstrakt Práce se zabývá rolí prezidenta republiky při jmenování, odvolávání a přijímání demise vlády, jejího předsedy a jejích členů. Strukturována je do úvodu, třech hlavních částí a závěru. Stručná první část nabízí základní přehled právní úpravy, která je pro téma práce relevantní, a to nejen z hlediska ústavního práva, ale i běžných zákonů a evropských předpisů. Druhá část se věnuje klasifikaci českého politického systému v trojici základních typů republikánských demokratických režimů, jimiž jsou prezidentský systém, poloprezidentský systém a parlamentní systém. Z této klasifikace pak jsou odvozena jistá základní východiska, která jsou v určitých situacích využitelná pro identifikaci systémově vhodnějšího výkladu. Tato část se zabývá i teoretickou možností změny typu politického systému pouze na základě faktického způsobu výkonu pravomocí prezidentem a nabízí pohled politologů a ústavních právníků na tuto problematiku. Třetí a hlavní část dělená do jednotlivých kapitol pojmenovaných podle pravomocí pak patří analýze odborné literatury a případně dalších publikovaných názorů teorie, mezi nimiž se pokouší najít převládající či přinejmenším z hlediska celkové systematiky vztahů prezidenta, vlády a...

The role of the President of the Republic in the appointment, acceptance of resignation and dismissal of the Government, the Prime Minister and members of the Government Abstract The thesis deals with the role of the President of the Republic in the appointment, acceptance of resignation and dismissal of the Government, the Prime Minister and members of the Government. It is structured into an introduction, three body parts and a conclusion. The first part offers a brief overview of the relevant legislation, not only in terms of constitutional law, but also ordinary acts and European regulations. The second part focuses on the classification of the Czech political system in context of the three basic forms of republican government, which are the presidential system, the semi- presidential system, and the parliamentary system. This classification establishes basic points of departure, which are useful in certain situations for the identification of a more systemically appropriate interpretation. This section also deals with the theoretical possibility of changing the type of government system solely based on the President's exercising his powers and offers the views of political scientists and constitutional lawyers on this issue.
