Abstract

Borders and their protection in the context of the International Human Rights Law and state sovereignty Abstract This diploma thesis deals with the state borders, especially their determination and protection in connection with the state sovereignty and contrast with human rights. It tries to answer the question of where the sovereignty and human rights meet within the protection of state borders. State borders define the state territory which is one of the features of the state, as perceived by Public International Law. The most precise definition of the state territory is essential from the point of view of the state itself, as it thus has an idea of the scope of its competence. The state exercises its territorial authority over its territory, just as it exercises its power over the inhabitants of that territory. At the same time, the state is obliged to ensure security on its territory and its inhabitants, which is related to the protection of the state borders and the need for their control by the state. The determination of the state borders and therefore their control is clearly related to state sovereignty. Hranice a jejich ochrana v kontextu mezinárodního práva lidských práv a suverenity státu Abstrakt Tato diplomová práce se zabývá státními hranicemi, zejména jejich určováním a ochranou v souvislosti se státní suverenitou a lidskými právy a snaží se odpovědět na otázku, kde se v rámci ochrany státních hranic setkává suverenita s lidskými právy. Státní hranice vymezují státní území, které je jedním ze základních znaků státu, tak, jak ho vnímá mezinárodní právo veřejné. Co nejpřesnější vymezení státního území je pro samotný stát zásadní, neboť tak má představu o rozsahu své působnosti. Nad svým územím totiž vykonává svou územní výsost, stejně jako vykonává svou moc i nad obyvateli tohoto území. Zároveň je povinen zajišťovat bezpečnost na svém území a svých obyvatel, s čímž souvisí ochrana státních hranic a potřeba jejich kontroly ze strany státu. Určování státních hranic a jejich kontrola tak jednoznačně souvisí se státní suverenitou. Ovšem přílišná ochrana a kontrola hranic se může snadno ocitnout v rozporu s lidskými právy, konkrétně např. se svobodou pohybu a pobytu. Pak je důležité zamyslet se a určit, která z těchto dvou hodnot by měla mít převahu. Zda je to státní suverenita, povinnost státu zajistit bezpečnost a určité právo státu na přehled o pohybu na jeho hranicích, nebo co možná nejširší svoboda...
