Abstract

The activity and importance of a notary in inheritance proceedings The topic of this rigorous thesis is the function and significance of the notary in the inheritance proceedings with a focus on activities aiming to fulfil the main goals and implementation of these functions in the inheritance proceedings as well as the clarification of the decision-making activities. The main objective of this rigorous thesis is to provide its reader an overview of issues related to the inheritance proceedings, specifically concerning the main objectives and functions of these proceedings as well as the decision-making activities and the importance of the notary. In accordance with the set objective, the core of the rigorous thesis is focusing on the activity of a notary fulfilling the main functions in the inheritance proceedings, i.e. on his legitimating and property function. Furthermore, the thesis concerns the decision-making function of the notary, as well as the decision-making process of the court in the inheritance proceedings or more precisely the decisions representing the result of this activity. Činnost a význam notáře v řízení o pozůstalosti Tématem této rigorózní práce je činnost a význam notáře v řízení o pozůstalosti, se zaměřením na činnost směřující k naplnění hlavních cílů a realizaci funkcí tohoto řízení, dále se zaměřením na činnost rozhodovací. Cílem této rigorózní práce je zejména zprostředkovat jejímu čtenáři přehled o problematice týkající se řízení o pozůstalosti, konkrétně týkající se hlavních cílů a funkcí tohoto řízení, rozhodovací činnosti a významu notáře s tímto souvisejícím. V souladu se stanoveným cílem je jádro předmětné rigorózní práce zaměřeno na činnost notáře naplňující hlavní funkce řízení o pozůstalosti, tedy na jeho funkci legitimační a majetkovou, dále na rozhodovací činnost notáře, okrajově na rozhodovací činnost soudu v řízení o pozůstalosti, resp. na rozhodnutí, která jsou této činnosti výsledkem. Rigorózní práce je strukturována následujícím způsobem. Začíná jejím úvodem. Dále je členěna celkem do pěti kapitol, které jsou následně podrobněji členěny na vzájemně provázané podkapitoly věnující se úzce vymezenému tématu týkajícímu se dané problematiky. První kapitola této rigorózní práce je jakýmsi historickým úvodem k danému tématu.
