Analýza politického diskurzu zákona "Třikrát a dost!" - z perspektivy kultury kontroly Davida Garlanda

Abstract

Main subject of this paper is political discourse of the Czech version of the "Three-strikes" law, which is an amendment of the law n. 111/2006, About help in material need. Amendment was submitted on 27.9.2018 by legislators led by Jan Baeur. Three-strikes law was promulgated in the collection of laws 8.9.2021 as law n.327/2021 and entered into force on 1.1.2022. The subject of the analysis will be shorthand records from parliamentary debate. The goal of analysis is to identify key arguments and their interpretation in David Garland' theory of culture of control. The work is divided into three main parts. In the first theoretical part I will study Garland' theory of culture of control and concepts of zero tolerance policies, three-strikes laws and problems of welfare surveillance. In the second part, I will examine the history of these policies both in Czech and international environment and I will try to place these policies into the theory of culture of control. In this section, I will analyse the Czech version of the three-strikes law in the history of Czech security development. In the third part, I will perform thematic analysis of parliamentary debate of three-strikes law in MAXQDA software. Práce je věnována výzkumu politického diskurzu zákona mediálně známého jako "Třikrát a dost", respektive novelizaci zákona č. 111/2006 Sb., o pomoci v hmotné nouzi, která byla předložena 27.9.2018 skupinou poslanců v čele s Janem Bauerem. Tento Zákon byl vyhlášen 8. 9. 2021 ve Sbírce zákonů v částce 143 pod číslem 327/2021 Sb. a vešel v platnost 1.1.2022. Předmětem analýzy budou stenozáznamy debat z jednotlivých čtení zákona v Poslanecké sněmovně parlamentu ČR. Cílem práce je identifikování základních argumentačních linií při projednávání daného zákona a jejich interpretování na základě teoretického rámce kultury kontroly Davida Garlanda. Práce je rozdělena do tří částí. V první teoretické části představím teorii kultury kontroly Davida Garlanda (culture of control), kterou doplním o další konceptuální rámce, a to sice nulovou toleranci, three-strikes law a welfare surveillance. V druhé části rozeberu jejich historický vývoj a praxe s nimi spojené. Zde budu vycházet jak ze zahraniční, tak domácí zkušenosti s danou problematikou a zároveň se je pokusím propojit právě skrze teorii kultury kontroly. Dále se budu zabývat samotnou novelou Třikrát a dost, co je jejím obsahem, a jakým způsobem ji lze zařadit do vývoje české bezpečnostní politiky.
