Abstract

Problematika obětí sexuálních deliktů a jejich ochrana prostředky trestního práva Abstrakt Tématem této diplomové práce je problematika obětí sexuálních deliktů a jejich ochrana prostředky trestního práva. Cílem práce je tuto problematiku teoreticky rozebrat, popsat specifika procesu viktimizace a zaměřit se na ochranu obětí sexuálních deliktů nástroji trestního práva. Autor si také v úvodu pokládá otázku, proč právě tyto oběti jsou tolik společností viktimizovány. Práce taktéž na vybraných místech hodnotí právní úpravu a jsou v ní navrženy i její možné změny. Samotná práce je rozdělena do šesti kapitol, přičemž každá z nich se zabývá různými aspekty tohoto tématu. První kapitola se věnuje současné právní úpravě vybraných trestných činů znásilnění, pohlavního zneužití a sexuálního nátlaku. Autor se zabývá i mírou jejich latence, která je u trestných činů proti lidské důstojnosti v sexuální oblasti poměrně vysoká. Ve druhé kapitole jsou definovány jednotlivé koncepce související s problematikou obětí sexuálních deliktů. Jedná se o pojmy jako oběť, zvlášť zranitelná oběť či falešná oběť. Dále je zde vymezena tzv. viktimnost a viktimogenní situace a faktory. Závěr této kapitoly je věnován popisu vztahu mezi pachatelem sexuálního deliktu a obětí. The issue of victims of sexual offences and their protection through criminal law Abstract The theme of this diploma thesis refers to the issue of victims of sexual offences and their protection through criminal law. This thesis aims to theoretically analyse this issue, describe the specifics of the victimisation process, and focus on protecting victims of sexual offences through criminal law. The author also asks in the introduction why these victims are victimised by so many. It also evaluates the legislation in selected areas and suggests possible changes in the legislation. The thesis itself is divided into six chapters, each of which deals with different aspects of this theme. The first chapter deals with the current legislation on selected crimes of rape, sexual abuse and sexual coercion. The author also discusses the degree of their latency, which is relatively high in crimes against human dignity in the sexual field. The second chapter defines the various concepts related to the issue of victims of sexual offences. These are terms such as victim, particularly vulnerable victim or false victim.
