Abstract

Forma a náležitosti výpovědi z nájmu bytu Abstrakt Diplomová práce cílí na formu a náležitosti výpovědi z nájmu bytu optikou požadavků vyplývajících jak z obecné úpravy právních jednání, tak z obecné úpravy nájmu až po specifika zvláštní úpravy nájmu bytu. Práce je rozdělena do osmi kapitol, kdy první se věnuje výpovědi ve světle obecných ustanovení o nájmu (autor zvolil věnovat tomuto samostatnou kapitolu, jelikož má za to, že tak bude dosaženo větší přehlednosti). Je zde popsána, jak úprava vlastní pouze obecnému nájmu, tak úprava společná i nájmu bytu. Druhá kapitola se věnuje formě výpovědi, tedy požadavku písemné formy. Tato kapitola zvlášť popisuje oba elementy písemné formy - písemnost a podpis. Dojití výpovědi byla s ohledem na rozsah této problematiky věnována samostatná třetí kapitola, která má snahu předestřít veškeré myslitelné situace, které mohou nastat při doručování výpovědi. Z důvodu rozsahu (jakož i z důvodu specifické povahy problému) byla jako samostatná vyčleněna i čtvrtá kapitola věnující se výpovědi podané elektronickou cestou. Tuto kapitolu považuje autor obzvlášť za důležitou, jelikož událostí poslední doby nás k užití elektronický prostředků tlačí stále víc a víc. Form and requisites of termination of the residential lease Abstract The thesis targets the form and requisites of notice of termination of a residential lease in the light of the requirements arising from both the general regulation of legal acts and the general regulation of the lease to the specifics of the special regulation of the residential lease.
